Freeze on evictions
On March 20, Governor Jared Polis announced Executive Order D 2020 012 temporarily limiting evictions, foreclosures, and public utility disconnections to mitigate, respond to, and recover from the current economic disruption due to the presence of COVID-19 in Colorado.
The Order directs the Department of Local Affairs (DOLA), Department of Labor and Employment (CDLE), and Department of Regulatory Agencies (DORA), to work with property owners and landlords to identify any lawful measure to avoid removing or executing eviction procedures against tenants or mobile home owners without cause or as a result of late or non-payment of rent or minor tenancy violations until April 30, 2020.
Court is NOT in session
Boulder County Courts stopped accepting all non-essential case filings until May 31, 2020. This includes all residential and business evictions. Therefore, no evictions can be filed until June 1, 2020.
Financial assistance for low-income households
Executive Order D 2020 012 also provides $3,000,000 from the Disaster Emergency Fund to DOLA to provide short-term rental and mortgage assistance to low-income households facing financial hardship due to economic disruption associated with COVID-19, prioritizing assistance to those who had continuous prior work history and lost employment related to CDPHE’s COVID-19 Public Health Orders.
Tenants may be eligible for unemployment benefits or may be able to get financial help depending on qualifications.
Public utility service assistance
- Public utility disconnections for delayed or missed payments are ordered to be temporarily suspended.
- Late fees and re-connection fees are to be waived for residential customers most impacted by COVID-19.
- Public utilities are directed to make reasonable efforts to reconnect service for customers disconnected for non-payment related to the impact of COVID-19.
- Public utilities are directed to develop and provide payment assistance programs to aid customers affected by COVID-19 in payment of utility bills.
